Rental Terms
These rental terms apply to all services and products provided by Offsite OÜ through the online store koduaed.ee. By booking and paying for a rental, the customer confirms that they have read and agree to these terms.
1. General
The online store koduaed.ee is operated by Offsite OÜ (registry code 14061956, KMKR EE101883197), located at Elise tee 1, Papsaare, 88317. Contact: info@koduaed.ee, +372 5885 7474.
Koduaed.ee primarily provides equipment rental services. In addition, we sell consumable goods (engine oil, saw chains, etc.) and personal protective equipment (work gloves, safety glasses, etc.) that can be ordered together with a rental in the same shopping cart.
2. The rental contract
The rental contract is formed when the customer submits a booking, pays for it through the online store, and Offsite OÜ receives payment confirmation.
The contracting parties are Offsite OÜ (the lessor) and the natural or legal person who placed the booking (the lessee).
3. Booking and rental period
The customer selects the rental equipment, the start and end dates, and submits the booking online. The price is calculated automatically based on the number of rental days. A rental day runs from the pickup day to the return day — for example, today to tomorrow is one day.
The rental period begins at the agreed pickup time and ends at the agreed return time. Both pickup and return take place at Elise tee 1, Papsaare, during published pickup and return hours, unless agreed otherwise in writing.
4. Price
All rental prices are shown on the product pages and include VAT.
The lessee is liable for damage to the equipment that goes beyond normal wear-and-tear (see clause 9).
5. Payment
Payments are processed through Maksekeskus AS (registry code 12268475), a licensed payment service provider authorised by the Estonian Financial Supervision Authority. The lessor does not have access to the customer's banking or card details.
The rental contract enters into force only after the payment has been received.
6. Pickup and return
Equipment is handed over and returned at Elise tee 1, Papsaare. Pickup and return hours are published on the contact page.
The lessee must present the booking confirmation (on a phone or printed) at pickup. Equipment is inspected together with the lessee at pickup and return.
If the lessee fails to return the equipment by the agreed time, the lessor may charge an additional rental fee for each started day of delay according to the daily rate of the equipment.
7. Use of the equipment
The lessee undertakes to use the equipment with due care, in accordance with the manufacturer's instructions and the purpose for which it is intended.
The lessee may not transfer the equipment to third parties or sub-rent it commercially.
The equipment must be returned clean and in the same condition as at pickup, except for normal wear-and-tear.
8. Safety requirements
The lessee confirms that, before using the equipment, they have read the safety instructions published with the product and the manufacturer’s manual.
To the extent permitted by law, the lessor is not liable for consequences arising from the lessee’s violation of safety requirements or the manufacturer’s instructions.
9. Damage and liability
The lessee is liable for damage to or loss of the equipment that goes beyond normal wear-and-tear.
The lessor estimates the cost of repair or replacement based on actual repair invoices or the current market value of the equipment. The lessee is invoiced for the amount within 14 days of return.
Damage caused by intentional misuse, gross negligence, or use contrary to the manufacturer's instructions is always charged in full.
10. Cancellation by the customer
A booking may be cancelled free of charge until 2 hours before the start of the pickup window on the first rental day: on weekdays the pickup window starts at 17:00, so the deadline is 15:00; on weekends it starts at 10:00, so the deadline is 08:00. The quickest way to cancel is the cancellation link in the order confirmation email; cancellations may also be sent to info@koduaed.ee. The full amount paid is refunded to the original payment method without delay, at the latest within 14 days. If the booking is cancelled after this deadline, or the equipment is not collected without cancelling, the rental fee may be retained; this never limits the statutory right of withdrawal where it still applies.
If a booking is cancelled less than 48 hours before the start of the rental period, the rental fee may be retained.
Cancellation requests must be sent to info@koduaed.ee.
11. Right of withdrawal (14-day rule)
A rental booked in the online store is a service contract concluded by means of distance communication. The customer may withdraw from it without giving any reason within 14 days of placing the order (Law of Obligations Act § 56). Withdrawal requests are sent as an unambiguous statement to info@koduaed.ee; the standard withdrawal form established under § 56 (2) is provided on request.
If the rental period starts within the 14-day withdrawal period, the lessor makes the equipment available during that period only with the customer's express prior consent, given with the checkbox at checkout, together with the acknowledgment that the right of withdrawal is lost once the rental has been fully performed (§ 53 (4) 1)). If the customer withdraws after the rental has started but before it has been fully performed, the customer pays a proportional share of the price for the rental days already provided and the remainder is refunded.
The free-cancellation guarantee in section 10 applies in parallel with the statutory right of withdrawal; whichever rule is more favourable to the customer applies. Amounts due are refunded to the original payment method without delay, at the latest within 14 days of receiving the withdrawal notice.
12. Cancellation by the lessor
The lessor may cancel a booking if the equipment is unexpectedly unavailable due to damage, theft, or force majeure. In such a case, the full amount paid is refunded.
13. Consumable goods and personal protective equipment sold with rentals
Consumable goods (engine oil, saw chains, etc.) and personal protective equipment (work gloves, safety glasses, etc.) are sold only as add-ons to a rental order. They are added to the same shopping cart as the rental and picked up together with the rental equipment at Elise tee 1, Papsaare. Home delivery for these goods is not offered.
These goods carry the statutory 14-day right of withdrawal counted from the day the customer receives them, and it applies equally when the goods are collected at our location. The customer may open the packaging and inspect the goods in the way that would be possible in a shop. If the goods have been used beyond what is necessary to establish their nature, characteristics and functioning, the lessor may deduct compensation for the diminished value of the goods (§ 56² (4)). The right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons once the seal has been opened, for example an opened container of lubricant.
The goods are returned to Elise tee 1, Papsaare during the published pickup hours within 14 days of the withdrawal notice. The refund is made to the original payment method without delay, at the latest within 14 days of receiving the notice, and may be withheld until the goods have been returned. Defective goods are always repaired, replaced or refunded under the seller's two-year liability period (§ 218).
14. Personal data
Personal data is processed in accordance with the Privacy Policy.
15. Disputes and applicable law
These terms are governed by the laws of the Republic of Estonia.
If a dispute cannot be resolved by negotiation, the consumer may contact the Consumer Disputes Committee (Tarbijavaidluste komisjon) at the Consumer Protection and Technical Regulatory Authority. As a final resort, disputes are resolved in Estonian courts.
